01About these terms

These Terms of Use (“Terms”) are an agreement between you and Luckycharm Primary Care PLLC (“Luckycharm,” “we,” or “us”), a Texas professional limited liability company. They cover your use of luckycharmprimarycare.com and any pages, forms, tools, and calculators on it (the “Site”). If you do not agree to these Terms, please do not use the Site.

Other documents also apply. Our Website Privacy Policy explains what the Site collects. Our Notice of Privacy Practices governs your medical information once you are a patient.

02The Site is not medical advice

Content on the Site, including health articles, service descriptions, calculators, and any chat tool, is for general information only. It is not a diagnosis or a substitute for care from a licensed clinician who has examined you. Using the Site does not create a doctor-patient relationship. A relationship begins only when you are seen as a patient. Read our full Medical & Emergency Disclaimer.

03Who may use our services

Anyone may browse the Site. Our clinical services are for adults 18 and older. Telemedicine visits are available only to patients physically located in Texas at the time of the visit.

04Forms, booking, and messages

• Website forms are not secure messaging. Contact, enrollment, and sign-up forms send information by email. Do not include detailed health information. Use the Patient Portal for medical questions.
• Online booking and the Patient Portal are provided by Elation Health. Your use of those tools is also subject to Elation’s terms and privacy policy.
• Submitting a form or booking request does not guarantee an appointment. We will confirm with you.
• You agree that the information you give us is accurate and that you are authorized to give it.

05Prices and calculators

Prices on the Site, such as our $125/month DPC membership, are current as of the date shown and may change. Savings calculators and HSA/FSA guidance are estimates for illustration only. They are not tax, legal, or insurance advice. Your plan or tax advisor makes the final call.

06Acceptable use

You agree not to:

• Use the Site for anything unlawful, or to harass, threaten, or impersonate anyone.
• Submit false information, spam, or another person’s information without permission.
• Try to access areas of the Site or our systems you are not authorized to use, or interfere with how the Site works.
• Copy, scrape, or republish Site content except as allowed in our Copyright notice.
• Use automated tools to collect data from the Site, or use Site content to train software, without our written permission.

07Our content and brand

The Site and its content, including text, articles, photos, video, graphics, and design, belong to Luckycharm or the people who licensed it to us. LUCKYCHARM PRIMARY CARE and our clover and stethoscope logo are registered trademarks (U.S. Reg. No. 8,351,945). See our Trademark Guidelines and Copyright notice.

08Third-party links and services

The Site links to and uses services run by others, such as Google Maps, Google reviews, social media, booking, and payment tools. We do not control those services and are not responsible for their content or practices. Their own terms apply.

09Disclaimer of warranties

We work to keep the Site accurate and available, but we provide it “as is” and “as available.” To the fullest extent the law allows, we make no warranties, express or implied, that the Site will be error-free, uninterrupted, or free of harmful code, or that its content is complete or current.

10Limitation of liability

To the fullest extent the law allows, Luckycharm and its physicians, staff, and owners are not liable for indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim about the Site is limited to $100. This section does not limit liability for medical care, which is governed by Texas law and the standards that apply to that care.

11Indemnity

If you misuse the Site or break these Terms, you agree to cover the reasonable costs, including attorney’s fees, that we incur because of it.

12Governing law

These Terms are governed by the laws of the State of Texas. Any dispute about the Site will be brought in the state or federal courts serving Gregg County, Texas. If any part of these Terms is found unenforceable, the rest stays in effect.

13Changes to these terms

We may update these Terms. The effective date at the top of this page shows when they last changed. Using the Site after a change means you accept the updated Terms.
